CRISTOBAL TRABALON CARRICONDO Industrial engineer (UPC), Industrial technical engineer in electricity and mechanics (UPC). Degree in Law (UOC). Referee by the Technical Arbitral Tribunal of Catalonia (TATC). He has been a maintenance manager for twenty years, currently responsible for engineering and legal maintenance at TMB. Author of several books of engineering, maintenance and legal construction. Professor at several UPC postgraduates.
Targets:
The course is proposed to know the three most important aspects of the maintenance of any installation from the point of view of regulatory compliance: the minimum contents of the maintenance plans from regarding operations, periodicities of interventions; Inspections and periodic checks and the essential aspects of legalization of facilities. But in addition an adequate Maintenance Management contemplates other aspects that are related to the current legislation and that have a relationship with the technicians and maintenance managers: it is the administrative, civil, professional, and criminal responsibility that they may incur the heads of Maintenance, as a result of their decisions; of the writing and interpretation of the maintenance contracts; and also of the PRL (Occupational Risk Prevention) regarding the responsibility that affects them.

Framed in practical aspects and of application to real cases, they will consider and discuss possible situations, which may be faced by a person in charge of Maintenance, placing a special emphasis on the prevention of damage.

  1. Introduction to the regulatory area. Special emphasis on European regulations. CE marking and service directives
  2. Responsibilities of maintenance managers
    • Agents of industrial security: roles, and responsibilities
    • Civil liability, responsibility for fault, objective responsibility for risk, professional responsibility, criminal liability.
    • Possible crimes related to maintenance management
  3. Maintenance contracts
    • Theory of contracts.
    • Preparation of Maintenance Contracts:
    • UNE Standard 13,269.
    • Objective interpretation of contracts.
    • Responsibility for breach of contracts.
  4. Approach to the Prevention of occupational risks in relation to maintenance
    • The Safety and Health in maintenance work.
    • Coordination of business activities
    • Subcontracting of maintenance work.
    • Prohibited assignment of workers
  5. Operations and periodicities of the regulatory maintenance
  6. Compulsory inspections and periodic checks
  7. Document management

Material scope: Visio synthesized and focused on the maintenance of: • Elevators • Crane bridges, forklifts • Other machines: swivel doors, escalators, etc. • Gas installations. • High and Low Voltage electrical installations • Fire protection (NEW REGULATION). • Facilities at the risk of Legionella. • Technical code of the building. • Legislation of noise. • Natural environment. • Thermal installations buildings. • Pressure equipment. • Refrigeration Facilities • Chemical Storage (NEW REGULATION). • Oil installations for own use. • Responsibilities and operations of Legal Preventive Maintenance.

To engineers and technicians that make decisions in Maintenance, not only responsible but any technician who acts in the field of management of maintenance. Due to its extensive and detailed content it is also applicable to: PRL managers, risk managers, FM (Facility Management) managers, plant, process, production, or Human Resources managers, Engineering technicians , Construction, and Installations, not only in industrialized areas, but also (and specifically) in infrastructure and buildings environments. Although the syllabus focuses and develops from a legal point of view, it is not necessary that the attendees provide any prior knowledge of law.
