[Course] LEGAL MAINTENANCE OF INDUSTRIAL FACILITIES

Aimed at: To engineers and technicians who make maintenance decisions, you are responsible not only for any technician who works in the field of maintenance management. Due to its broad and detailed content, it is also applicable for: PRL, risk managers, FM (Facility Management), plant, process, production, or Human Resources managers, engineering technicians, Construction, and facilities, not only in industrialized areas, but also (and specifically) in infrastructure and building environments. Although the syllabus is approached and developed from a legal perspective, it is not necessary for the attendees to provide any prior knowledge of law.

  1. Introduction to the regulatory field. Special emphasis on European provisions. CE marking and service directives
  2. Maintenance managers responsibilities
    • Industrial Security Agents: Roles, and Responsibilities
    • Civil liability, liability for fault, objective liability for risk, professional liability, criminal liability.
    • Possible offenses related to maintenance management
  3. Maintenance contracts
    • Theory of contracts.
    • Preparation of maintenance contracts:
    • Standard UNE 13.269.
    • Objective interpretation of contracts.
    • Liability for breach of contracts.
  4. Approach to the Prevention occupational risks in relation to the maintenance
    • Health and Safety in Maintenance work.
    • Coordination of business activities
    • Outsourcing of Maintenance work.
    • Prohibited transfer of workers
  5. Operations and regularities of regulatory maintenance
  6. Mandatory periodic inspections and checks
  7. Document management
  8. Case studies

Material scope: Synthesized vision focused on the maintenance of: • Lifting equipment • Crane bridges, forklifts • Other machines: revolving doors, escalators, etc. • Gas connections. • High and Low Voltage electrical installations • Fire protection (NEW REGULATION). • Facilities with risk of legionella. • Technical Building Code. • Noise law. • Natural environment. • Thermal installations buildings. • Pressure equipment. • Refrigeration installations • Storage of Chemicals (NEW REGULATION). • Oil facilities for own use. • Legal Preventive Maintenance responsibilities and operations.

Documentation: The documentation will be available on the platform 24 to 48 hours before the start of the training. In the case that there is additional documentation after the training, we will provide it later.
Certification: Upon completion of the training, students will receive a certificate of attendance that can be downloaded on the platform.
Targets: The course proposes to know the three most important aspects of the maintenance of any installation from the point of view of regulatory compliance: the minimum contents of maintenance plans in terms of operations, periodicity of interventions; regular inspections and inspections and the legal aspects of installation legalization. But also a proper Maintenance Management contemplates other aspects that have to do with the current legislation and that have a relation with the technicians and heads of maintenance: these are the administrative, civil, professional, and criminal liability that they can incur the heads of Maintenance, as a result of their decisions; the drafting and interpretation of maintenance contracts; and also of the PRL (Occupational Risk Prevention) regarding the liability that affects them.

Framed in practical aspects and of application to real cases, possible situations will be raised and debated, which a Maintenance Manager may face, with a special emphasis on preventing damage.
