My company tells me that, since I am in an ERTO, due to the pandemic caused by the Covid-19, I am not the one who has to apply for the benefit in the SEPE, which will already be taken care of at work. Is that so, I don’t have to apply for it, just authorize my company to ask for it for me?
Indeed. It is the company that, through a collective request, must send us the information of all the workers affected by the ERTO.
As a result of Covid-19, I am affected by an ERTO in my company, where I have been working for two months. I hadn’t worked there before and therefore I don’t have any previous quotes. Do I have the right to access unemployment benefits?
Yes, as the right to contributory protection for unemployment is recognized to people affected by these ERTOs, even if they do not have the minimum contribution period for this.
Are temporary workers affected by an ERTO, as a result of Covid-19, also entitled to unemployment benefits?
Yes. All workers affected by extraordinary measures who were working before March 18, 2020, including temporary workers, are entitled to unemployment benefit.
I am a worker affected by an ERTO, in a company where I work part-time and, in addition, I have a full-time contract in another company. Can I receive unemployment benefits from the company in which I stop working?
Since you keep another job full time there is a situation of incompatibility that does not allow you to access unemployment benefits. You will not be entitled to unemployment benefits as long as this situation continues.
I am hired part time by two companies. In one of them we are in suspension ERTO for the Covid-19 from March 24. The other company, which is cleaning work, did not suspend its activity as it was considered essential, so I will continue to work. Can I receive unemployment benefits for what I have stopped working for?
Yes, you can access the unemployment benefit, but the proportional part will be deducted from the amount to be received during the time you work in the contract you maintain.
I am registered as a self-employed person in the RETA and I work more part-time in a company that has included me in an ERTO. Am I entitled to unemployment benefits?
Self-employment is incompatible with unemployment benefits or allowances. If you were registered as a self-employed person on the date on which you were affected by the measure, or on the date on which your entitlement was born, you would not be entitled as you would not be unemployed.
I work in a company that has included me in an ERTE and I am also in the domestic service. Do I have the right to access unemployment benefits?
You will be able to access the unemployment benefit for the contract affected by the suspension or reduction of working hours as long as the work in the domestic service is part-time. In this case, the part proportional to the time worked in the contract of employees of the household that you maintain will be deducted from the amount of the benefit.
I lost an unemployment benefit because I started working three months ago in a company that has now taken up an ERTO. Do I have to resume my suspended benefit?
You do not have to resume your benefit, but you will be able to receive a new one during the time that your contract is suspended by the Covid-19, without consuming the previous one. If in the future you are stopped again, in order to determine your right, it will act as if you have not been recognized now. You can resume the benefit that was once suspended or, if necessary, request a new one.
I ran out of benefits six months ago because I started working for someone else in a company that has now included me in an ERTO. Since I do not have enough time to receive a contributory benefit, should I now resume the same subsidy I had suspended or will I start another subsidy?
You will be recognized as a contributory unemployment benefit, and you will receive it as long as your contract is suspended or your working day is reduced for this reason. You will be able to resume the interrupted benefit when you find yourself in a legal situation of unemployment again, unless you are then entitled to a contributory benefit.
How do I change my bank details to collect the benefit in another account?
You will have to deal with the company and have it contact the SEPE provincial management. The problem will be solved with the request of the company, through e-mail or in writing sent by the Central Electronic Registry, sending the change of the data or data that affect you in the way that the company agrees with the SEPE.
If I am receiving a contributory benefit and taking a medical leave or my maternity-paternity starts, how do I report to the SEPE during this period of the state of alarm for the Covid-19 ?
You can report this situation by telephone, establishing with the operator how to send the corresponding documentation, which will be the medical leave or the document for which you are granted the maternity or paternity benefit. You can also request a virtual appointment through the SEPE website so that a manager can assist you in this procedure.
While I am receiving unemployment benefit from ERTO, due to the Covid-19 crisis, can I work part-time or full-time at another company? How would this affect the amount I receive in benefits? In the event that you start working full time, the incompatibility benefit will be suspended. If the job you started was part-time, you would be able to make it compatible, deducting from the amount to be received the proportional part corresponding to this new job.
