THE TERMS AND ITS COPYRIGHT IN THE NEW LAW OF ADMINISTRATIVE PROCEDURE

There are a number of new features in the calculation of administrative deadlines :

·          Saturdays are excluded from the calculation of terms: therefore, when the deadlines are indicated in days, they are understood as non-working days on Saturdays, Sundays and public holidays, provided that a Law or the Law of the Union European does not express other calculation (art. 30.2).

·          The term calculation is regulated for the first time in hours, without being able to exceed 24 hours: in this case, all hours of the day that form part of a business day are capable (art. 30.1).

How are the deadlines calculated:

a) The periods expressed by hours will be counted from time to time and minute in minute from the time and minute in which the notification or publication of the act in question (Article 30.1) takes place.
b) The reasonable times in days will be counted from the day after the one in which the notification or publication of the act in question takes place, or from the next to the one in which the estimation or the dismissal by silence take place administrative (article 30.3).
c) The periods set in months or years will be calculated from the day after the notification or publication of the act in question, or from the next to the one in which the estimate occurs or dismissal for administrative silence (art. 30.4).

How to calculate deadlines for the purposes of electronic records:
The electronic register of each administration or body will be governed for the purposes of the deadlines for the official date and time of the electronic access headquarters.

The operation of the electronic register will be governed by the following rules (article 31.2):

a) It will allow the presentation of documents every day of the year for 24 hours.
b) For the purposes of calculating deadlines set on business days, the presentation on a non-working day will be understood to be made in the first hour of the next business day, unless a norm expressly allows reception on a non-working day
