For the exercise of the qualified professions, it is an indispensable requirement to be incorporated in the professional association that corresponds to the unique or main professional domicile of the engineer, fact that will allow him to exercise in all the Spanish territory.
The Law refers to the professional exercise in all the extension of the perimeter of performance that, in the case of the industrial technical engineers, is very wide and that does not confine exclusively to the technical projection and his facultative direction, but that Compulsory membership extends to the professional practice that involves technical advice, the issuance of expert opinions or technical studies, audits, safety and health coordination, etc. The Law provides that they are a very serious infraction, among other cases, “the exercise of a collegiate profession by those who do not comply with the obligation of membership”, but also “the hiring by companies and entities of non-collegiate workers. in the event that the object of their employment contract includes, in whole or in part, the performance of tasks specific to the profession ”.
The schools can report these infractions to the Generalitat de Catalunya to initiate the mandatory procedure. It should be remembered that professional associations ensure that professional practice complies with regulations, ethics and good practices by promoting the quality of services provided in substance and form, combating professional intrusion and ensuring such that the rights and interests of the persons to whom the professional action is addressed are respected, thus generating the confidence, credibility and security that the collegiate professional will act correctly.
