Publication in the DOGC of the Regulation that unfolds the Industrial Safety Law 12/2008

As of today, March 8, 2010, the following provision has been published in the DOGC:

Decree 30/2010, of March 2, which approves the regulations for the implementation of Law 12/2008, of July 31, on industrial safety.

Law 12/2008, of July 31, on industrial safety, regulates and defines a model of management of industrial security that is based on the externalization of the inspection services now subject to a prior administrative authorization regime and under The control of the Administration, which corresponds to the Catalan Agency for Industrial Safety and pursues, with regard to the provision of inspection services, three essential objectives: guaranteeing adequate territorial coverage, ensuring its quality and establishing a competence effective and loyal among the operators. The law establishes the essential characteristics of this management model, the requirements and obligations applicable to the inspection operators, as well as the functions of control of the Administration that include the inspection and sanctioning authority, however, leaves for the future To regulate the deployment and the concretion of these general conditions to allow the complete operation of the model.
Thus, this regulation establishes the legal regime applicable to inspection operators, but also regulates the legal regime applicable to all the agents that are part of the industrial safety management system and that are subject to a legal authorization regime or previous communication:
  • the entities of conformity assessment of industrial products
  • the industrial risk assessment entities
  • the professionals and the companies of installation, maintenance, repair and operation of installations and industrial products and the repair workshops of automobile vehicles.
The regulation is structured in eight titles, nine additional provisions, seven transitional provisions, a derogatory provision and four final provisions.
