MANIFEST IN DEFENSE OF SECURITY AND REGULATION OF TECHNICAL WORKS

Professional engineering colleges want to highlight the serious consequences that, for the safety of people, can be derived from the misapplication of the Omnibus Law.

In the coming weeks, the Government will approve a royal decree that will determine what jobs are to be undertaken and which ones are not. The institutions that promote this manifesto and those who support it consider that it is necessary to warn of the real risk of lack of guarantees for citizens that can occur if the visa disappears. This Law wanted to take advantage of the transposition of a directive to introduce changes that it did not demand; A major reform in a hurried and untreated way with the sectors involved. In addition to the legal uncertainty derived from a law that, according to many experts, is manifestly unconstitutional and regulates aspects attributed to the autonomous communities.

The disappearance or reduction of the scope of the visa could cause a situation of uncontrolled, deprived and insecure:

• That people without knowledge or attributions legally - recognized exercise the profession of engineer with the corresponding risk for the security of the people.
• That the insurance guarantees granted by a project visa disappear and the compensation can not be effective in the event of any damage to the people.
• That professionals do not want to take on projects of high interest - common but with a high potential risk for the difficulty of obtaining insurance.
• Restricting competition among professionals in not - being able to assume some of them, individually, the guarantee for civil liability.
• That a person sanctioned or disabled continue to carry out - projects.
• That there is a lack of deontological control over the - professional who signs a project.

Until now, schools have watched the actions of our colleagues respond to the interests and needs of society in relation to professional practice; we have guaranteed the fulfillment of good practice and the deontological obligations of the profession; And we have ordered, represented and defended the profession and society. Now, with the new regulatory framework, all this is called into question.

Therefore, WE REQUIRE :

• The maintenance of the visa as a social function of control and security of technical work and compulsory schooling of professionals who carry out tasks that must be visas.
• That the royal decree draft prepared by the various ministries involved be agreed with the professional colleges involved.
• That the Government open a path of dialogue with professional colleges to agree on the formulation of the visa, without in any case affecting the guarantee that it currently represents for the citizens.
• To allow colleges, as experts, and certain entities, as advocates of the rights of consumers and users, propose to the Government new visa models capable of guaranteeing in a more effective way the rights that the omnibus Act wants to safeguard.
• That any application that supposes a substantial change will be accompanied by a reasonable period of transition that allows to guarantee, in an effective way, the fulfillment of the obligations of the professionals with the citizens.

Technical professional colleges represent professionals who work by generating employment and wealth, at the same time we watch for this exercise to be done with total guarantee for the citizens. The visa represents 0.0085767% of Spanish GDP, which is so small that it can not be compromised by security. If security in Catalonia works, why should you put yourself at risk? For this reason, we demand projects with a guarantee.
