The Generalitat will have to present a draft industrial safety law before January 2008

The concessions of the ITV ended on 23 July and 10 September regarding the provision of the control service in the field of safety, quality and industrial regulations.


The Government will have to develop a new regulation on industrial safety and within a period of 18 months after the entry into force of the new law governing the transition period (July 22, 2006), it will have to present a project Law before the Parliament of Catalonia.

The Parliament of Catalonia approved in July a Law that regulates the steps to follow for the provision of inspection services in the field of industrial safety. As you know, on July 23, 2006, the validity of the administrative concessions for the provision of the technical inspection service of vehicles in Catalonia was finished. The Government of the Generalitat approved the Decree that regulated this final period, at the proposal of the Department of Work and Industry, in order to offer legal security to current operators until the entry into force of the new regulations.

On the other hand, on September 10 also ends the validity of administrative concessions for the provision of the regulatory control service in the field of safety, quality and industrial regulations.

From these dates, these services must be provided in accordance with the regulations of the Generalitat that complement the current state basic legislation taking into account the autonomous competences plus the ruling of the Constitutional Court of December 15, 2005 that recognizes the competition in favor of the Generalitat in matters of technical inspection of vehicles.
