On February 17, 2004, the Third Section of the Administrative Contentious Chamber of the Supreme Court issued a ruling on the administrative appeal lodged by the General Council of Official Associations of Industrial Engineers, by means of which it was annulled the requirement to carry out a practical examination for industrial engineers to obtain the Low Voltage Individual Qualification Certificate. In the aforementioned Judgment, it was considered that industrial engineers have the legal capacity to execute any type of technical work within the scope of their knowledge, without the Administration being able to require said graduates to undergo an exam that contemplates subjects already included in the degree they have.
On August 26, 2004, was published in the Official Gazette of the Generalitat de Catalunya, Decree 363/2004, of August 24, regulating in Catalonia the administrative procedure for the application of the Electrotechnical Regulation for at low voltage. Article 13 of this autonomous decree regulated the necessary requirements to obtain the Low Voltage Individual Qualification Certificate and, in accordance with the Supreme Court Judgment, excluded from the need to carry out a practical examination for industrial engineers.
After the entry into force of this Decree, the College of Industrial Technical Engineers of Barcelona stated before the Department of Labor and Industry the need to extend this exemption to industrial engineers, in application of the Judgment given by the Supreme Court on February 17, 2004. Although this ruling was not pronounced on our profession, there are sufficient legal arguments that also justify the abolition. For example, it should be recalled that the first article of Royal Decree Law 37/1977, of June 13, on the attributions of industrial experts, provides that they will have identical faculties that industrial engineers, with certain quantitative limitations that do not affect the assumption of the execution of the electrical installations of low voltage.
CETIT considers this decision to be important news that, in short, not only modifies a Decree but prevents an injustice facing our profession while demonstrating the ability of the group of Industrial Technical Engineers of Catalonia to defend our rights in front of all possible instances.
