LAST ACTIONS OF THE CNMC ON THE EVALUATION REPORTS OF BUILDINGS AND FAVORABLE SENTENCE OF NATIONAL AUDIENCE

The National Markets and Competition Commission (CNMC) has issued a press release, which, among other things, mentions in detail its actions and achievements with regard to the competent technicians that can perform the Building Evaluation reports

It is worth highlighting the ruling that allows Technical Engineers and Engineers to issue ITEs, and prevents the exclusivity of Architects and Technical Architects in issuing them. It is the first sentence regarding the Market Unity Guarantee Law (LGUM) and activity reserve, and applicable throughout Spain, which is why it is a very important ruling. Similarly, the note mentions the existence of more open procedures regarding the Market Unit, and the exclusivity of the intervention of some professionals, to the detriment of others.

In addition, in the press release, it is mentioned that they will file a contentious-administrative appeal against the decree of the Ministry of Housing, Public Works and Vertebration of the Territory of the Valencian Community through which only architects and technical architects can write the reports of buildings evaluation (ITEs).
